A well-designed Asset Protection Plan will protect your assets from creditors, as well as drastically reduce federal estate and generation skipping taxes through the creation of an Asset Protection (or Dynasty) Trust.

As Asset Protection Trust, also called a Dynasty Trust, is typically formed during the lifetime of the trustor (trust creator) with the assistance of a knowledgeable Estate Planning and Trust lawyer.  The Dynasty Trust is a long-term, irrevocable trust that can either be funded during your lifetime, or upon your death. The decision regarding when your Asset Protection Trust will be funded should be made with the assistance of an experienced Estate Planning attorney, as the timing of the trust funding may have an impact upon the estate taxes your beneficiaries will be held liable for.

Asset Protection Trusts (Dynasty Trusts) have several advantages and disadvantages. The Claremont Asset Protection and Estate Planning Lawyers at Wilkinson & Wilkinson will thoroughly review these advantages and disadvantages as they pertain to your unique financial situation.

The Revocable Living Trust avoids probate, but does not provide any protection from creditors, bankruptcy or judgments.

However, assets that are transferred (gifted or sold) to an irrevocable trust funded into a corporation, a partnership or limited liability company can be shielded from third party claims.

While no structure provides 100% protection, if funded and administered properly, such entities can serve as powerful deterrents to any legal claim(s) or third party creditors. At the same time, these structures can effectively be employed to reduce transfer taxes as well as facilitate asset protection for your heirs, protecting your assets from their creditors, and from their possible future divorce and/or possible future bankruptcy claims.

If you need help with estate planning, asset protection, business succession planning, trust administration, or information about probate & conservatorships or probate litigation, please please contact one of the experienced Estate Planning & Probate Attorneys from the Claremont Law Firm of Wilkinson & Wilkinson at (909) 482-1555.
