Question 6: What is the Cost of Probate?

The attorney does not set the probate fees. The State of California provides a statutory fee schedule for both the Executor and Attorney Fees. The Fees are based on a percentage of the gross value of the assets probated. For example, the statutory fees are not reduced by any debt or liabilities attributable to the estate. For a $500,000 estate the attorney fees and the executor fees would be approximately $13,000 each.
