Frequently Asked Questions

Question 1: Will a simple will avoid Probate and Conservatorship?

No, a simple or complex will requires that an executor be appointed by the probate court and the assets in the estate be transferred to the named beneficiaries through a court process called probate. Nor does a will avoid the necessity of a Conservatorship proceeding (similar to probate) if you become disabled and cognitively incapacitated.
